Terms and Conditions of Choicelify

Part I — General Terms

Applicable to all users of the Platform.

1. Introduction and Acceptance

Welcome to Choicelify.

Choicelify is a public opinion social platform that allows individuals and organizations to create polls, publish content, express positions, and participate in public debate in real time.

By accessing or using Choicelify (the "Platform"), you agree to be bound by these Terms and Conditions ("Terms"), the Privacy Policy, and the Community Guidelines. If you do not agree with any of these documents, you must not use the Platform.

Continued use of the Platform constitutes a reaffirmation of such acceptance.

2. Eligibility

To use Choicelify you must:

  • Be at least 13 years of age, or the minimum legal age required in your jurisdiction.
  • Have the legal capacity to accept these Terms.
  • Provide truthful information during registration and use of the Platform.

Choicelify reserves the right to suspend or cancel accounts that provide false or misleading information.

3. Account Registration and Linked Policies

Before using the Platform, you must accept:

  • These Terms and Conditions.
  • The Privacy Policy.
  • The Community Guidelines.

Acceptance of these documents is mandatory. By registering or continuing to use the Platform, you declare that you have read, understood, and accepted them in their entirety.

4. User Content

You retain ownership of the content you publish on Choicelify.

By publishing content, you grant Choicelify a worldwide, non-exclusive, royalty-free license to:

  • Display and distribute such content within the Platform.
  • Store it on Choicelify's systems.
  • Analyze it for analytics, moderation, and service improvement purposes.

You are solely responsible for the legality, accuracy, and appropriateness of the content you publish. Choicelify does not endorse opinions expressed by users.

5. Prohibited Conduct

You agree not to:

  • Use bots, abusive automation, interaction farms, or any artificial system to manipulate polls, votes, metrics, or trends.
  • Impersonate other individuals or organizations.
  • Distribute illegal, offensive, defamatory, discriminatory, violent, or fraudulent content.
  • Harass, threaten, or intimidate other users.
  • Attempt to exploit technical vulnerabilities of the Platform.
  • Publish content that infringes the intellectual property, image, honor, or privacy rights of third parties.

Artificial manipulation of votes or interactions may result in immediate permanent suspension of the account.

6. Moderation and Enforcement

Choicelify may, at its sole discretion:

  • Remove or limit the visibility of content that violates these Terms or the Community Guidelines.
  • Suspend or cancel user accounts.
  • Permanently ban users who engage in serious or repeated violations.

Moderation decisions are at Choicelify's discretion and may be executed without prior notice when the severity of the situation requires it.

7. Intellectual Property

The name Choicelify, its logo, brand elements, interfaces, source code, algorithms, databases, technological architecture, methodologies, designs, and all other technological or graphic elements are the exclusive property of Choicelify S.A. de C.V. or its licensors, and are protected by applicable intellectual property law.

Access to the Platform does not grant the user any ownership rights over these elements, but only a limited, personal, revocable, non-exclusive, and non-transferable license to use the service in accordance with these Terms.

Copying, reproducing, reverse engineering, decompiling, or commercially exploiting any element of the Platform without express written authorization from Choicelify is not permitted.

8. Disclaimer of Warranties

The Platform is provided "as is" and "as available." Choicelify does not warrant:

  • The accuracy, completeness, or truthfulness of user-generated content.
  • Uninterrupted or error-free availability of the service.
  • That poll results constitute conclusive statistical representations or definitive diagnoses of any kind.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Choicelify shall not be liable for:

  • Indirect, incidental, or consequential damages.
  • Loss of profits or lost business opportunities.
  • Reputational harm resulting from content published by users.
  • Decisions made by users based on Platform results, metrics, or trends.
  • Service interruptions, cyberattacks, connectivity errors, or misuse of credentials.

10. Governing Law

These Terms shall be governed by the laws of the Republic of Honduras, without prejudice to the application of international data protection standards or other regulations that may be relevant due to the digital and cross-border nature of the Platform.

Any dispute shall first be attempted to be resolved through direct communication and amicable negotiation. If no resolution is reached, the parties may resort to the legal or alternative dispute resolution mechanisms applicable under the governing law.

11. Changes to the Terms

Choicelify may update these Terms at any time for operational, technological, legal, or commercial reasons. Users will be notified of material changes through the Platform, email, or other official channels. Continued use of the Platform after the publication of modifications implies acceptance of the new terms.

Part II — Business Terms

Applicable to accounts of organizations, companies, and institutions using Choicelify for commercial, institutional, or research purposes.

12. Business Access and Nature of Service

Choicelify offers business features that may include audience segmentation, statistical analysis, results dashboards, report exports, community management, content moderation, participation verification, sponsored campaigns, and technical support, among others.

Choicelify acts as a facilitating technology platform. Accordingly, it does not guarantee that the results obtained constitute absolute truths, definitive diagnoses, conclusive scientific studies, or statistical representations of any population, unless a specific methodology has been expressly contracted and documented.

Choicelify reserves the right to modify, expand, limit, suspend, or replace features when deemed necessary to improve the service, protect system security, or comply with legal obligations.

13. Obligations of Business Users

Business users agree to use Choicelify in a lawful, ethical, transparent, and responsible manner. In particular, they must:

  • Create surveys, campaigns, and publications that respect the law, human dignity, and the rights of third parties.
  • Clearly communicate the purpose of their surveys when the nature of the data processing requires it.
  • Refrain from using misleading, manipulative, discriminatory, or unlawful questions.
  • Not induce users to disclose sensitive data without legal basis, valid consent, or legitimate purpose.
  • Not manipulate responses, results, metrics, algorithms, or participation mechanisms.
  • Not use bots, abusive automation, or artificial methods to alter results or trends.
  • Respect the confidentiality, privacy, image, honor, and intellectual property of users, third parties, and Choicelify.
  • Comply with payment obligations and commercial conditions agreed with Choicelify.
  • Be responsible for damages arising from misuse of the Platform by their internal users or authorized third parties.

14. Surveys, Campaigns, and Business Content

Business users are responsible for the content of their surveys, questions, response options, images, texts, publications, campaigns, and any other material they upload, generate, or manage within Choicelify.

The business declares that it has the rights, authorizations, licenses, consents, and legal bases necessary to publish such content and to collect, process, or analyze the information derived from its campaigns.

Choicelify may review, limit, suspend, remove, or block surveys, campaigns, or publications when it reasonably considers that they violate these Terms, the Community Guidelines, third-party rights, or applicable legal provisions.

15. Data Processing and Results

Business users acknowledge that Choicelify may collect, store, process, analyze, aggregate, anonymize, or structure information derived from surveys, responses, interactions, metrics, and Platform usage, in accordance with the Privacy Policy and the contracted service conditions.

When a business uses Choicelify to collect information from users, it must respect the principles of purpose, proportionality, transparency, confidentiality, security, and lawfulness, as well as the rights of data subjects.

Choicelify may generate statistical reports, participation metrics, trend analyses, and derivative products from processed information. Unless expressly authorized or required by law, Choicelify will endeavor to ensure that business reports do not involve the individual identification of users when not necessary for the contracted purpose.

16. Advertising, Promotions, and Sponsored Content

Businesses may use Choicelify to develop consultation campaigns, sponsored surveys, brand studies, market analyses, or publications directed at specific audiences, provided such activities are lawful, transparent, and compatible with Platform policies.

The business is responsible for the accuracy, legality, and clarity of any advertising message, incentive, benefit, prize, sweepstake, or promotion conducted within the Platform. Choicelify shall not be liable for obligations offered directly by the business to users, unless expressly agreed otherwise.

17. Confidentiality

Business users agree to maintain strict confidentiality regarding all technical, commercial, statistical, strategic, methodological, or operational information they access through the use of Choicelify.

Information obtained through the Platform may not be disclosed, transferred, sold, or used for purposes other than those authorized by Choicelify, the participating users, or applicable law. This obligation shall survive even after the termination of the relationship between the business user and Choicelify.

18. Commercial Conditions and Payments

Access to business features may be subject to free plans, paid plans, corporate licenses, institutional contracts, or specific commercial conditions.

Business users must timely comply with agreed payments, fees, renewals, and applicable taxes. Failure to pay, default, or non-compliance with commercial conditions may result in suspension, limitation, or cancellation of Platform access.

Unless otherwise agreed in writing, payments made for services that have been enabled, used, or made available are non-refundable.

19. Suspension or Termination of Business Service

Choicelify may temporarily or permanently suspend a business's access when fraudulent activities, poll manipulation, violation of these Terms, non-payment, publication of prohibited content, or any conduct that compromises the integrity of the Platform or the rights of its users is detected.

Suspension or termination shall not automatically give rise to a right to indemnification, refund, or compensation, unless expressly provided otherwise in a contract. The business shall remain responsible for outstanding obligations and damages caused during the use of the Platform.

20. Effective Date

This document enters into force upon its publication and shall remain in effect indefinitely, subject to periodic revision or update.

By accepting these Terms, the business user declares that they have read, understood, and accepted these Terms and Conditions, as well as the linked policies, and is legally bound by them from the moment they access, register, contract, create surveys, manage campaigns, or use any service of Choicelify.
